BILL NUMBER: S8250 SPONSOR: CLEARE TITLE OF BILL: An act to amend the correction law, in relation to requiring the commis- sioner of corrections and community supervision to assess and update the security camera, land-mobile radio, and public address systems in use in correctional facilities PURPOSE: This legislation aims to ensure that the $400 million appropriation in the SEY 25-26 for the installation of surveillance camera across New York State correctional facilities is fully implemented within two years. It guarantees that these funds are directed strategically toward enhancing safety, communication, and accountability infrastructure in correctional institutions. CLEARE -- read twice and ordered printed, and when printed to be committed to the Committee on Crime Victims, Crime and Correction AN ACT to amend the correction law, in relation to requiring the commis- sioner of corrections and community supervision to assess and update the security camera, land-mobile radio, and public address systems in use in correctional facilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 112 of the correction law is amended by adding a new subdivision 7 to read as follows: 7. (A) NOT LATER THAN NINETY DAYS AFTER THE EFFECTIVE DATE OF THIS SUBDIVISION, THE COMMISSIONER SHALL: (I) EVALUATE THE SECURITY CAMERA, LAND-MOBILE RADIO, AND PUBLIC ADDRESS SYSTEMS IN USE IN CORRECTIONAL FACILITIES AS OF THE EFFECTIVE DATE OF THIS SUBDIVISION; AND (II) SUBMIT TO THE GOVERNOR AND THE LEGISLATURE A PLAN FOR ENSURING THAT ALL CORRECTIONAL FACILITIES HAVE THE SECURITY CAMERA, LAND-MOBILE RADIO, AND PUBLIC ADDRESS SYSTEM COVERAGE AND CAPABILITIES NECESSARY TO: (1) ENSURE THE HEALTH AND SAFETY OF STAFF AND INCARCERATED INDIVID- UALS; AND (2) ENSURE THE DOCUMENTATION AND ACCESSIBILITY OF VIDEO EVIDENCE THAT MAY PERTAIN TO MISCONDUCT BY STAFF OR INCARCERATED INDIVIDUALS, NEGLI- GENT OR ABUSIVE TREATMENT OF INCARCERATED INDIVIDUALS, OR CRIMINAL ACTIVITY WITHIN CORRECTIONAL FACILITIES. (B) THE PLAN REQUIRED PURSUANT TO PARAGRAPH (A) OF THIS SUBDIVISION SHALL: (I) IDENTIFY AND INCLUDE PLANS TO ADDRESS ANY DEFICIENCIES IN THE SECURITY CAMERA SYSTEM IN USE AT CORRECTIONAL FACILITIES, INCLUDING THOSE RELATED TO: (1) AN INSUFFICIENT NUMBER OF CAMERAS; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
